AN ORDINANCE PRESCRIBING FEES AND CHARGES FOR THE USE OR RENTAL OF LIGHT AND HEAVY EQUIPMENT, COTTAGE OR SIMILAR STRUCTURE AND FOR CONVEYANCE TRANSPORTING FOREST, AGRICULTURAL, LIVESTOCK, AQUACULTURE AND MARINE PRODUCTS WITHIN THE MUNICIPALITY AND FOR OTHER PURPOSES.

WHEREAS, Section 186 Chapter 5, Title one, Book 2 of the Local Government Code of 1991 states that the Local Government Units may exercise the power levy taxes, fees and charges x x x;

WHEREAS,as additional source of revenue of the municipality while providing job opportunity to the people;

Be it ordained by the Sangguniang Bayan of Baganga in regular session assembled, that:

Section 1. Imposition of Fee. The following fees shall be as follows for:

1 (a) Rental fees of Heavy and Light Equipments:

a) Excavator Komatsu IC200 Php 2,595.00/hr.
b) Dump Truck 6-wheeler Isuzu 807.00/hr.
c) Dump Truck 10-wheeler 1,127.00/hr.
d) Grader Komatsu 1,775.00/hr.
e) Road Roller 1,705.00/hr.
f) Elf Truck Isuzu 800.00/hr.
g) Prime Mover (Self-loading) 178.00/hr.
h) Pay loader 1,176.00/hr.
i) Hino Water Tanker (10-wheeler) 1,127.00/hr.
j) Rice Planter 500.00/hec.
k) Rice Harvester sharing 1 bag
in every 15 bags.

2 (a) Rent of Cottage  (According to size)

3 (a) Conveyance Loaded with:

g) Fieldstone, sand, gravel and mineral ores (per truckload or fraction thereof) 1,000.00

Section 2. – Payment – The fee imposed herein shall be paid to the Municipal Treasurer or his/her authorize representative.

Section 3. – Administrative Provision – The assigned revenue collection Clerk shall maintain a separate ledger from generated incoming collection.

Section 4. – Penalty – Any violation of the provision under of this ordinance shall be punished by a fine of 3,000.00 or imprisonment of not less than 1 month but not more than 6 months or both such fine and imprisonment at the discretion of the court.

Section 5. – Repealing Clause – All ordinances contrary or inconsistent with the provisions herein are deemed repealed or amended.

SECTION 6. – Effectivity Clause – This ordinance shall take effect upon approval.
